The present text starts from an old discourse on racial democracy in Brazil, however, very current, since it is common nowadays to identify people and institutions in society, defending the inexistence of racism in Brazil. This “flag” of Brazilian racial democracy, hoisted after abolition, stands for the violation of the human rights of black women. In this sense, the research aims to reflect on the inequalities in the exercise of human rights resulting from institutional acism, particularly regarding access to health by black women. Therefore, it is a literature review, with the objective of exploratory research and a qualitative approach, which proposes the method of intersectional analysis to understand the structural inequalities of places thus instituted by the State and crossed by conjunctures of oppression. It is a fact that black women inherited many ills of slavery. However, it is believed that there are ways to combat racism and exism, among which it is worth mentioning the importance of reviewing the documents and legal bases associated with the vulnerabilities faced by black women, as well as the elaboration of norms considering ethnic-racial parameters. and gender, and the concrete inspection of the effective implementation of the National Policy for the Comprehensive Health of the Black Population.
